ACHTUNG: Internet-Seiten-Betreiber: #ePrivacy – Richtlinien umzusetzen!ATTENTION: Internet-Publisher: #ePrivacy – Directive must trueATENCIÓN: editores de Internet: #ePrivacy – Directiva debe verdadero

Was ist also zu tun:

Facebook/Google+/Mail etc.)!Briefly what it is about: Storage of data, in particular Cookies

Whom it concerns: respectedly 90% of all Internet page operators

DANGEROUSLY: This EU directive which was given in 2009 by the EU and would have had to be moved at national level till May, 2011 is already partial in strength!

Internet-Cookies which collect data or collect about their technology data may be used only if a consent was given by the Site-Surfers and was informed about what is stored about the Cookies!

Where Cookies are used: Joomla, WordPress, many other CMS-, shop, chat, order systems etc. Roughly respectedly 90% of all interactive Internet sites, dispose of Cookies, e.g., to hold Login-Sessions openly etc. you offer the possibility to store certain settings of users, so that these must be not always grasped anew, but also the pursuit and storage of the user’s behaviour (Google-Tracking)!

Therefore, are obliged sooner or later, all web page operators who pursue your Internet sites from the EU to move this directive! But also operators beyond the EU which your sides on the aim area of states straighten in the EU have to keep to this directive!

For France and Great Britain, the national conversion has already occurred! Now the sides which are directed to the aim area of France or Great Britain already have to keep to this directive!

What is to be done:

partly unclear is the directive still, but in France and Great Britain which have moved the directive, can be taken for it as an example:

Possibility 1:

Disconnection all Cookies on all web pages

Possibility 2:

Approval of the Surfers catch up, before Cookies are used! Besides, is to be explained which Cookies and what are stored in the Cookies.

    1. Thanks for your comments. Looking back, I rliease my penultimate paragraph wasn’t as clear as it could have been. My aim was to acknowledge that the use of cookies as strictly necessary in order to provide an information society service explicitly requested by the subscriber was acceptable, as defined by the directive. An interesting angle that I didn’t touch upon is the potential conflict between this directive and best practice accessibility. Depending on how the interaction is handled, requiring people to give consent for cookies could raise some serious barriers. The mechanism itself must be accessible to everyone. There can be no exceptions, or the directive becomes meaningless to anyone unable to give their consent. As it stands, one of the merits of looking at the browser to do this, is that there is a good level of accessibility already in place.Enabling people to make an informed decision will be difficult enough to begin with. How many people actually read license agreements before installing software? Doing this for people with cognitive and learning disabilities will be quite another challenge altogether.I’ll take a look at the articles you and Mike link to. Thanks for the suggestions.

  2. Website publishers suolhd not be told to go ahead if they want to use cookies. The law in most European jurisdictions require that consent is obtained prior to cookie placement, and regulators across Europe are capable of enforcing it. In addition telling them that they will be able to rely on future Browser Settings will just lead to confusion and disrespect for the law.Consent cannot be assumed from default Browser settings or the absence of Do-Not-Track indications because most citizens do not have the technical knowledge needed to understand them. This was recognised by the data protection regulators and drafters of the law, which has been debated and accepted by the UK parliament and those across Europe. It is possible that browser manufacturers could introduce features in the future that would give visitors the fine-grained ability to register agreement to cookies, but web site publishers would still not be able to rely on that because they may not be able to detect whether a particular visitor was using a new browser and had been given the information required to give their consent. Legal responsibilities rests with the web publishers alone. In any case most of the browser manufacturers get significant income from data aggegation and behavioural tracking and may not be motivated to design features that they think would reduce that.Guidance issued by various data protection regulators and the Article 29 working group has indicated that consent to cookies does not have to be obtained at every visit. It is perfectly acceptable to get agreement once and place cookies without asking on subsequent visits, although it is recommended that the consent suolhd expire after a reasonable period. Solutions to the cookie consent issue that allow website publishers to comply with law simply and cheaply are already available. There is no need to rely on, or wait in vain for, mythical browser settings . The commercial interests behind advertising and data aggregating are short sighted to try and obfuscate this issue because they are pitting themselves against the populace. Very many citizens feel there is a lack of respect about how their personal information is acquired and used on the web, and this is leading to lack of trust that could in fact inhibit the acceptance of online commerce. It is also wrong for politicians to take sides with the aggregators for the sake of protecting economic growth. It is common sense that visitors to web sites suolhd be made aware if cookies, or any other kind of identifying data, are being place in order to track their online activity, and be given the the ability to refuse them. Ultimately ensuring transparency and honesty in online commerce will lead to more consumer trust and a more sustainable online economy.See my guest post on
